By accessing or placing an order on our website, you agree to be bound by these Terms. Please read them carefully before proceeding.
Kalpa Florist is owned and operated by Kalpa Florist, based in Jalandhar, Punjab, India (hereinafter referred to as “Kalpa Florist”, “We”, “Us”, or “Our”). The customers are referred to as “You”, “User”, or “Your”.
1. Eligibility & Account Registration
Our website is available to individuals who can form legally binding contracts under Indian law. Persons below the age of 18 may use the website only under the supervision of a parent or legal guardian.
To place an order, you may be required to register an account by providing accurate details including your name, address, contact number, and email ID. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Kalpa Florist reserves the right to suspend or cancel any account at its discretion without prior notice if found in violation of these Terms.
2. Products & Pricing
All products listed on our website — including flowers, cakes, combos, chocolates, dry fruits, and gift items — are subject to availability. Product images, descriptions, and prices are for reference only and may be updated without prior notice.
Prices displayed are inclusive of applicable taxes unless stated otherwise. While we strive to offer the best value, Kalpa Florist does not guarantee that our prices are the lowest in the market. We reserve the right to modify prices at any time.
In the event of a typographical error in price or product description, we reserve the right to cancel the order and issue a full refund, even after order confirmation.
3. Orders & Order Acceptance
Placing an order on our website constitutes an offer to purchase. Your order is not confirmed until you receive a confirmation via email or SMS from us. We reserve the right to accept or decline any order at our discretion.
We may require additional verification before processing certain orders. You are responsible for providing accurate recipient details including name, delivery address, and contact number. Incorrect information may result in failed delivery for which Kalpa Florist shall not be held liable.
4. Substitution Policy
Flowers are natural products and seasonal availability may vary. In cases where a specific flower variety or product is unavailable, Kalpa Florist reserves the right to substitute with an item of equal or higher value, maintaining the overall aesthetic and quality of the arrangement.
For cakes, slight variations in design, colour, or decoration may occur as all our cakes are handcrafted. Flavour substitutions may occur in rare cases due to regional or temporary unavailability. Our team will make every effort to notify you before making any substitution.
5. Cancellation & Modification Policy
Orders scheduled for same-day delivery are processed immediately and cannot be modified or cancelled once placed. For all other orders, cancellation requests must be submitted at least 24 hours prior to the scheduled delivery time.
To request a cancellation or modification, please contact us via our website contact page. If the order has already been dispatched or prepared, cancellation will not be possible and the full amount will be charged.
Kalpa Florist reserves the right to cancel any order due to unforeseen circumstances such as natural calamities, supplier issues, or events beyond our control. In such cases, a full refund will be initiated.
6. Delivery Policy
6.1 General Delivery
We deliver across Jalandhar and select cities in Punjab and India (Pan India delivery available for select products). The estimated delivery time is subject to the delivery location, product type, and time of order placement.
For same-day delivery, orders must be placed before 4:00 PM local time (IST). For midnight deliveries, orders must be placed before 6:00 PM on the day of delivery.
6.2 Delivery Attempts
For perishable items such as cakes and flowers, only one delivery attempt will be made. If delivery is unsuccessful due to any of the following reasons, the order will be considered as executed and no refund will be applicable:
- Incorrect or incomplete delivery address provided by the customer
- Recipient unavailable or unresponsive at the time of delivery
- Premises found locked
- Recipient refusing to accept the delivery
We recommend that you inform the recipient about the expected delivery to avoid failed attempts.
6.3 Special Delivery Locations
For deliveries to hospitals, hostels, hotels, or other institutional addresses, please include the complete address, room/ward number, and the recipient’s contact number to ensure successful delivery. Kalpa Florist will not be responsible for delays or failed deliveries at such locations due to institutional access restrictions.
6.4 Force Majeure
Kalpa Florist shall not be held liable for delays in delivery caused by circumstances beyond our reasonable control, including but not limited to floods, political unrest, bandhs, traffic disruptions, or COVID-19-related restrictions. In such events, we will endeavour to reschedule the delivery and inform you proactively.
7. Payment Terms
We accept payments via UPI, Net Banking, Debit/Credit Cards (Visa, Mastercard, RuPay), and other available digital payment methods. All transactions are processed through secure third-party payment gateways. Kalpa Florist does not store your payment card details.
Payment must be made in full at the time of placing the order. Cash on delivery may be available for select orders and locations at our discretion.
8. Returns & Refund Policy
Due to the perishable nature of our products, we do not accept returns. However, if you receive a damaged, incorrect, or significantly different product from what was ordered, please contact us within 24 hours of delivery with photographic evidence.
Approved refunds will be processed within 7–10 working days to the original payment method. Refunds for cancellations (where eligible) will be initiated within 5–7 working days.
9. Intellectual Property
All content on kalpaflorist.com including images, text, logos, designs, and graphics are the property of Kalpa Florist and are protected under applicable intellectual property laws. Reproduction, redistribution, or commercial use of any content without our written permission is strictly prohibited.
10. Limitation of Liability
Kalpa Florist’s liability in any circumstances shall be limited to the value of the order placed. We shall not be liable for any indirect, incidental, or consequential damages arising out of the use of our services. Our liability for personal injury or property damage arising from our negligence shall be governed by applicable law.
11. Governing Law
These Terms & Conditions shall be governed by the laws of India and the jurisdiction of the courts in Jalandhar, Punjab shall apply in case of any disputes arising out of or in connection with these Terms.
12. Changes to These Terms
Kalpa Florist reserves the right to update or modify these Terms & Conditions at any time without prior notice. The revised Terms will be effective from the date of posting on the website. Continued use of our website after such changes constitutes your acceptance of the updated Terms.
